§1
General provisions

This document is an information clause in accordance with art. 13 para. 1 and 2 of the Regulation of the European Parliament and of the Council (EU) 2016/679 dated 27/04/2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data and the repeal of Directive 95/46 / EC (hereinafter: RODO) for persons (clients) using data administrator services.

The administrator of personal data within the meaning of art. 4 point 4 RODO is Boryszew S.A. Administrator in accordance with art. 32 para. 1 The RODO respects the principle of personal data protection and applies appropriate technical and organizational measures to prevent accidental or unlawful destruction, loss, modification, unauthorized disclosure or unauthorized access to personal data processed in connection with its operations.

Providing personal data by the customer is voluntary. However, it is a necessary condition to conclude a contract whose subject matter are services provided by the administrator or products offered by him. The customer is obliged to provide personal data, and the consequence of not providing data is the inability to use the administrator’s offer.

§2
Curpose and basics of personal data processing

The administrator processes personal data for the following purposes:

  • concluding and implementing sales contracts, the subject matter of which are products offered by the data controller ,;
  • providing services electronically available on the data administrator’s websites (eg newsletter);
  • sending marketing information regarding the product or service offer of the data controller.

The basis for the processing of personal data is:

  • 6 par. 1 b) the GDP for the purposes referred to in para. 1  a – b;
  • 6 par. 1 a) and f) the GDP for the purposes referred to in para. 1 c – d.

Recipients of data. Transmission of data to third countries

Recipients of personal data processed by the administrator may be entities that supply or deliver to persons who purchase data administrator products. Personal data will not be transferred to countries outside the European Economic Area.

Period and scope of personal data storage

The data controller shall store personal data for a period of time related to the term of the contract, the implementation of which is related to the processing of data and in the event of termination of the contract no longer than:

  • for a period of time in which the data subject may exercise his powers under the administrator’s warranty for defects in the sold item or guarantee, unless a longer period of storage is required by applicable law;
  • for a period of 5 years for personal data included in the settlement documents (invoices) in accordance with the Accounting Act;
  • until the consent to the processing of personal data has been withdrawn.

The Administrator collects and processes personal data provided in the contact form containing: name, surname, e-mail address, telephone number, name and address of the company, and only e-mail address in relation to subscribers of the newsletter.

The rights of the data subject

Any person whose personal data is processed by an administrator has the right to access their data, the right to rectify it, delete (“the right to be forgotten”), processing restrictions, the right to data transfer, the right to object and the right to withdraw consent to processing data at any time. Withdrawal of consent should be delivered in person or by registered mail to the following address: Boryszew S.A. Branch of Boryszew ERG in Sochaczew; 96-500 Sochaczew,  15 Sierpnia 106. Any person who decides that his / her personal data is processed by the administrator in violation of the provisions of the RODO, has the right to lodge a complaint to the President of the Office for Personal Data Protection

Profiling

Personal data obtained by the data administrator is not processed automatically – including in the form of profiling.

Cookies

Our website (www.boryszewerg.com.pl) uses cookies. These are small text files sent by the web server and stored by the browser software on the user’s computer. When the browser reconnects with the site, the site recognizes the type of device the user connects to. Parameters allow to read information contained in them only to the server that created them.
